Report of the Committee on Reference and Counsel

NC-01-41 MS That the Evangelical Lutheran Church in Canada sponsor and support a series of day–long consultations across the synods to offer opportunities for worship and dialogue on matters of theological, ethical and social concern between people of our congregations and missions whose ministry is amongst ethnic–heritage or aboriginal communities.

NC-01-42 MS That the Evangelical Lutheran Church in Canada in convention acknowledges the requirement of all people in Canada and elsewhere, access to safe water; that the National Bishop convey our concerns to the Prime Minister of Canada and invite the synodical bishops to convey our concerns to the respective premiers, asking that adequate regulatory measures be put in place to protect Canada's water supply and ensure safe water for all people.

NC-01-43 MS That the ELCIC in convention through the National Bishop commend the work of the Canadian Ecumenical Jubilee Initiative and that this convention express to the government of Canada, its support for the call for a renewed relationship between Aboriginal and non–Aboriginal peoples based on mutual respect, responsibility and sharing.

NC-01-44 MS That the ELCIC join the Royal Commission on Aboriginal Peoples and the United National Rights Committee in calling on the federal government to establish an independent commission with the mandate to implement Aboriginal land, treaty and inherent rights, and that the National Bishop will communicate this action to the Prime Minister.

NC-01-45 MS That the church bylaws, Part V, section 13 (page 28 of the Constitution) be amended as follows:

Section 13. The privilege of the floor shall be granted at all times to all members of the National Church Council and of the Court of Adjudication and to the synod bishops and to the President of the Evangelical Lutheran Women of the Evangelical Lutheran Church in Canada, and to the official youth participants.

MS That this church's constitution, Article X, Section 5, (page 7 of the Constitution) which reads, "The voting membership of conventions shall consist of," be amended with the addition of the following item:

c. Lay delegates who shall be at least 15 years of age and less than 22 years of age at the time of the convention, and who shall be elected by the synods in numbers consistent with synodical representation on the National Church Council.

MS That the National Church Council be instructed to amend the Evangelical Lutheran Church in Canada: Manual re Discipline of Ministers, the "Rules for Synod Committees on Discipline" (Bulletin of Reports, Appendix 7, P.X.34), Section C17 be amended to read as follows:

The rules of evidence and other rules used in formal judicial proceedings shall not necessarily apply to the hearing. Testimony or documentary evidence shall not be excluded merely because it would be excluded under such formal rules. For example, evidence However, hearsay (defined as evidence regarding things not seen or heard by the witness but reported by her/him for another) shall not be excluded. merely because it is hearsay, although individual members of a Committee on Discipline may choose to give hearsay evidence little or no weight or importance.

and that the National Church Council report back on this matter to the Convention in 2003.

Report of the Committee on Elections

Chairperson Rev Marty Tuer advised that the biographical data for the final four candidates for Vice–President had been distributed.

The third ballot for the Vice–President of the ELCIC was distributed.

The Chair declared balloting closed.

Report of the Committee of Reference and Counsel cont'd.

MS That this church instruct the National Church Council to provide up to $10,000 for the relocation of the retiring National Bishop.

MS That the motion be amended to change the amount to $6,000.

MS That this item be referred to National Church Council.

MOTION TO REFER DEFEATED

The parliamentarian advised that this matter should be referred to NCC as per ELCIC Administrative Bylaw Part V, Section 17 which states that: "When a motion calling for an appropriation of funds comes before the convention from any source other than the National Church Council, it shall be referred at once to said council for consideration and report."

MS That the bylaw be suspended until this matter is dealt with.
